The countdown is running for one of life’s ultimate deadlines. Liberty Tax Service reminds taxpayers that the filing deadline for 2006 taxes will be Tuesday, April 17th, 2007. Taxpayers will have extra time to file and pay because April 15th falls on a Sunday in 2007, and the following day, Monday, April 17th is Emancipation Day, a legal holiday in the District of Columbia.

April 17th is also the deadline for starting or contributing to an existing IRA retirement account. As taxpayers face the April 17th federal tax filing deadline, those who owe taxes have some choices. Liberty Tax Service will offer extended hours during the final days of the tax filing season.

It’s Time To File Taxes Or An Extension Request

IRS will grant an automatic six-month filing extension to taxpayers who timely file an extension request. No reason for the request needs to be provided. Individual taxpayers will file Form 4868, Application for Automatic Extension of Time to File U.S. Individual Income Tax Return, by April 17th and receive a filing extension until October 15th. Corporations will file only Form 7004, Application for Automatic Extension of Time to File Corporation Income Tax Return, to request and receive a six-month extension.

“However, an extension of time to file a tax return still does not constitute an extension of time to pay any tax liability. Penalties and interest accrue from April 17th, if the tax liability has not been paid,” said John Hewitt, CEO and Founder of Liberty Tax Service.

Installment Plans For Those Who Owe

What can someone do who owes the IRS money but can’t pay the full amount by April 17th? Taking out a bank loan may be the least costly option. Another option is to ask the IRS for permission to make monthly installment payments. If you are not currently on an IRS installment plan, complete Form 9465, Installment Agreement Request, and attach it to your return. To limit penalty and interest charges, you should pay as much of the tax due as possible when sending in your return.

Taxpayers who have already mailed or electronically filed their returns can mail Form 9465 to the appropriate IRS Service Center. The IRS usually approves or denies installment requests within 30 days of receipt. However, if your request is dated later than March 31, it may take longer.

The IRS will approve or deny the request by sending out a written response. If the request is approved, the IRS will charge a fee that will be deducted from the first installment payment and will send instructions on how to make the monthly installment payments. These payments must be made on time, and the taxpayer must agree to meet all future tax liabilities. An option to ensure timely payments is to have the funds directly debited from a bank account. By checking Line 13 of the Form 9465, the IRS will send the required direct debit enrollment form.

Taxpayers can charge their taxes owed to MasterCard, VISA, Discover or American Express Card. They can also pay on the internet by going to http://www.pay1040.com, http://www.officialpayments.com, or call 1-888-PAY1040 (1-888-729-1040) or 1-800-2PAY-TAX (1-800-272-9829). A convenience fee applies.

Taxpayers still have until April 17th to open a traditional Individual Retirement Arrangement (IRA) that may help them lower their tax liability for this year. Liberty Tax Service reminds you that for taxpayers covered by a pension plan at work, the modified adjusted gross income limit for deducting traditional IRA contributions has increased. How To Form A Limited Liability Company (Llc) In California

File the Articles of Organization

Complete the Articles of Organization (Form LLC-1). You can download the form at California Secretary of State web site under Business Programs > Business Entities > Forms, Samples and Fees. You must designate an Agent for Service of Process, which can be either an individual living in California or a corporation registered in California, to accept court papers on your behalf should your LLC ever be sued. Your LLC cannot be its own Agent for Service of Process. The filing fee for Form LLC-1 must be submitted with Form LLC-1 and mailed to the California Secretary of State or delivered in person.

File the Statement of Information

In a few weeks you will receive a date stamped copy of the Form LLC-1 you filed from the Secretary of State. Enclosed in the same envelope will be a Statement of Information (Form LLC-12) for you to complete and return to the Secretary of State. . You must file Form LLC-12 within 90 days of your LLC registration and include a check for the filing fee. Form LLC-12 is a biennial statement, which means it has to be filed every two years.

Get an EIN

Register for a Federal Employer Identification Number (EIN) on the IRS web site under Businesses > Employer ID Numbers. You should get an EIN for your LLC even if you don’t plan on hiring someone to work for you because you will need it when applying for a business bank account (unless you don’t mind using your SSN!).

First meeting and operating agreement

Hold your LLC’s first meeting and take meeting minutes (even if you are a Single Member LLC). The meeting should essentially cover the name and business premises of the LLC, when/where the LLC was formed, and its appointed members/managers. You will need these minutes to open your business bank account. You should also create your LLC’s Operating Agreement at this time. The Operating Agreement is for your internal records and is not to be provided to the Secretary of State or the bank.

Open a business bank account

Open a business checking account for your new LLC. You will need to show them your EIN, filed Form LLC-1, and the first meeting minutes of your LLC, along with a government photo ID of its appointed member/manager.

Determine your tax obligations

Complete and file California Form 3522 (LLC Tax Voucher) with the Franchise Tax Board. Include a check for 0 to pay for your annual LLC tax. Read the instructions on Form 3522 carefully to determine when you should file and pay. Depending on your business type and location, you might be subjected to paying additional taxes (besides federal and state).
